These Terms of Service (“Terms”) govern your use of Land Fortune’s website, apps, payment features, and WhatsApp Business chatbot (the “Services”). By accessing or using the Services, you agree to these Terms.
1. Who we are
Land Fortune operates an agricultural and general marketplace connecting buyers and sellers in Zimbabwe, including ordering and support through WhatsApp.
2. Eligibility
- You must be at least 18 years old and able to form a binding contract.
- You must provide accurate registration and contact information.
- Sellers must have authority to list and sell the products they offer.
3. Accounts
You are responsible for safeguarding login credentials and for activity under your account or WhatsApp-linked phone number. Notify us promptly of unauthorised use. You can delete your account in the Land Fortune app under Account → Settings → Delete account. See how account deletion works.
4. Marketplace conduct
- Listings must be lawful, accurately described, and fairly priced.
- You must not engage in fraud, scams, harassment, or illegal trade.
- We may remove listings, suspend accounts, or refuse service for policy or legal risk.
- Land Fortune may provide the platform only; unless stated otherwise, contracts for goods are between buyer and seller.
5. Orders, payments & delivery
- Prices, fees, and availability may change until an order is confirmed.
- Payments are processed by licensed partners (for example banks, mobile money, or card gateways). Their terms also apply.
- Delivery times are estimates and depend on sellers and logistics partners.
- Refunds and disputes follow the seller’s and payment provider’s rules, plus any Land Fortune buyer-protection process we publish.
6. WhatsApp chatbot
- By messaging our WhatsApp Business number, you request automated and/or agent-assisted replies about products, carts, checkout, and orders.
- Standard WhatsApp / Meta / mobile carrier terms and data charges may apply.
- Do not send unlawful content or attempt to abuse the bot.
- We may rate-limit, block, or stop automated responses to protect the Service.
7. Acceptable use
You agree not to: reverse engineer the Services except as allowed by law; probe or disrupt systems; scrape at abusive volumes; upload malware; or misuse personal data of others obtained through the platform.
8. Intellectual property
Land Fortune branding, software, and content we publish are owned by us or our licensors. You may not copy or reuse them without permission. You retain rights to content you upload, and grant us a licence to host and display it to operate the marketplace.
9. Disclaimers
The Services are provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted or error-free operation.
10. Limitation of liability
To the fullest extent permitted by law, Land Fortune is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill. Our total liability for any claim relating to the Services is limited to the greater of (a) fees you paid to Land Fortune for the transaction giving rise to the claim in the prior 3 months, or (b) USD 50.
11. Indemnity
You agree to indemnify Land Fortune against claims arising from your listings, content, misuse of the Services, or violation of these Terms or applicable law.
12. Privacy
Our Privacy Policy describes how we handle personal information and forms part of these Terms.
13. Suspension & termination
You may stop using the Services at any time. We may suspend or terminate access for breach, legal risk, or platform integrity. Provisions that should survive (liability, indemnity, IP) will survive termination.
14. Governing law
These Terms are governed by the laws of Zimbabwe. Courts in Zimbabwe have exclusive jurisdiction, without prejudice to mandatory consumer protections.
15. Changes
We may update these Terms by posting a revised version on this page. Continued use after the effective date constitutes acceptance.
